Composition

The composition of the Higher Rights Assessment Board (the Assessment Board) is stipulated in sections 39E(3) and 39E(5) of the Legal Practitioners Ordinance (Cap. 159) as follows:

1. (3)The Assessment Board consists of -
   1. (a)a chairperson appointed by the Chief Justice, who must be an eligible person;
   2. (b)9 other members appointed by the Chief Justice, of whom -
      1. (i)2 must be eligible persons;
      2. (ii)3 must be solicitors who engage in litigation work in the course of ordinary practice;
      3. (iii)3 must be Senior Counsel; and
      4. (iv)one must be a Law Officer or a Principal Government Counsel of the Department of Justice; and
   3. (c)one other member selected by the chairperson from among the members of the panel appointed by the Chief Justice under subsection (5).
2. (5)For the purposes of subsection (3)(c), the Chief Justice may appoint a panel of persons whom the Chief Justice considers suitable for selection as members of the Assessment Board and who are not, in the opinion of the Chief Justice, connected in any way with the practice of law.
